1. Introduction
1.1 The use of this website(s) (hereinafter the “Website(s)”) is provided by Royal Jumbo B.V., located at Westzijde 184, 1505 EK Zaandam, The Netherlands (hereinafter referred to as “Jumbo”) and subject to the following Terms & Conditions.
1.2 Your use of this Website(s) constitutes acceptance of these Terms and Conditions as at the date of your first use of the site(s).
1.3 Jumbo reserves the rights to change these Terms and Conditions at any time by posting changes online. Your continued use of this Website(s) after changes are posted constitutes your acceptance of this agreement as modified. If you do not wish to agree to the new conditions, you should notify Jumbo of this fact in writing and from that moment cease use of the Website(s).
2. Use and measures
2.1 You agree to use this Website(s) only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the Website(s) by any third party.
2.2 If Jumbo has sufficient reason to believe that you are guilty of unlawful acts, Jumbo may take appropriate measures. These measures could include blocking the created profiles or IP addresses. The following acts are regarded as unlawful:
(a) conducting offensive, discriminatory or threatening communications in reviews or on forums or otherwise on the Website(s), (b) behaving in a way that causes a disruption or disturbance of the Website(s), (c) gaining access to Jumbo's administration or information and use it for sending unsolicited email (spam) and / or (d) otherwise acting contrary to the conditions mentioned in this agreement.
3. Registration and Privacy
3.1 To create a wish list, participate in a forum or a contest, leave a review or receive a newsletter, you need to register. Registration takes place by choosing a unique username and entering a valid email address. In order for you to register you have to be at least 16 years old or have permission from your parents and / or guardian.
3.2 By creating an account on one of Jumbo's Websites, you agree that Jumbo has access to your account information to investigate complaints and / or other allegations of abuse.
3.3 When you register for a service of Jumbo, you agree that other users of these services are able to contact you via Jumbo. Additionally, your data will be made available to Jumbo, as indicated in the Privacy Policy. When you enter your data, you retain the right to change your mind and ask Jumbo for your data to be adjusted or removed.
3.4 It is solely your responsibility to ensure that your account password is kept a secret. For security or other reasons, Jumbo might request that you change your login details. You may not transfer or estrange the account or relationship with Jumbo without the prior written consent of Jumbo. Jumbo may assume that all communications made from your account come from you.
3.5 Any communication or material that you transmit to, or post on, any public area of the Website(s) including any personal data, questions, comments, suggestions, or the like, is, and will be treated as, non-confidential and nonproprietary information.
3.6 Jumbo at all times reserves the right, without giving any reason, to disqualify a user or IP address and / or to close his account if there is an infringement of one or several conditions within this agreement or other rules of conduct that can be found on the Website(s). All of Jumbo’s decisions are final and binding. If a user's account is blocked or deleted, this user may not re-register before Jumbo gives him written permission.
3.7 Jumbo respects the privacy of all users and shall ensure that the information you provide will be kept confidential. Jumbo uses your information where applicable: forum, newsletter, wish list and reviews. For other uses, Jumbo will only use your information with your permission, or if so requested by a competent authority or forced by a judge. Jumbo will not sell your information to third parties, as stated in the Jumbo Privacy Policy. You agree to this Privacy Policy when you register for an account on one of Jumbo’s Websites or through one of the partner Websites of Jumbo.
4. Intellectual property
4.1 The Website(s), web documents, illustrations, graphics, logos, sounds and programs, including software, are the intellectual property of Jumbo and are copyrighted and trademarked. Any unauthorized use or unauthorized distribution by disclosure of confidential information, the reproduction or copying and use, in whole or in part, of this Website(s), etc. is prohibited.
4.2 Copyright restrictions:
a. Commercial use or publication of all or any item(s) displayed is strictly prohibited without prior authorization of Jumbo. Nothing contained herein shall be construed as conferring any license by Jumbo to use any item displayed.
b. Documents may be copied for personal use only on the condition that copyright and source indications are also copied, no modifications are made and the document is copied entirely. All rights are reserved on these documents and permission to copy them must be requested from the copyright owners.
5. Liability
5.1 This Website(s) and the information, names, images, pictures, logos regarding or relating to products or licenses of Jumbo are provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied. In no event will Jumbo be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use or in connection with such use or loss of use of the Website(s), whether in contract or in negligence.
5.2 Although Jumbo handles her Website(s) with great care, Jumbo can not guarantee that the functions, services, information and other materials contained in her Website(s) will be uninterrupted or error free, that defects will be corrected, or that this Website(s) or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the materials. The visible information on the Website(s) can also be obsolete due to technical reasons (caching or otherwise). For this Jumbo will not assumes liability. Jumbo is furthermore not liable for:
a. damage a User may suffer as a result of access to the account by an unauthorized person.
b. problems concerning internet connections,
c. failed, incomplete, garbled or delayed computer transmissions;
d. possible printing or typographical errors, online or offline, in material relating to the Website(s);
e. possible damage that occurred when in connection with or as a result of the information and / or services of the Website(s).
5.3 Jumbo is not obliged to continue the presented Website(s) in the future and has the right to end, temporarily disable or remove one of her Website(s) at any time and at its discretion when a computer virus, bug, hacker attack or other cause disturbs or deregulates the administration or security of the Website(s). Jumbo is also free in its chosen range of information and services on its Website(s).
5.4 Jumbo takes no responsibility for the content of external websites that are somehow linked to this Website(s).
5.5 You will indemnify Jumbo for all liabilities, damages and costs that may arise from the infringement of these Terms by you or through a computer that you use to access the Website(s).
6. Other
6.1 If any condition stated in this agreement is void or voidable, then the validity and enforceability of the remaining conditions in this agreement are not affected and the void or voidable condition will - if necessary - be adapted or replaced in line with these Terms and Conditions.
6.2 Jumbo has the right to transfer her rights and obligations under agreement with her users to third parties. If this occurs, Jumbo will inform you.
6.3 In case of participation in a contest or promotion of Jumbo, the General Conditions for contests and promotions apply, as well as specific terms and conditions which apply to, and are mentioned at, the relevant contest or promotion.
6.4 If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on this Website(s) relating to specific information, material or promotional activities then the latter shall prevail.
6.5 These Terms and Conditions shall be governed and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the Courts of the Netherlands.
6.6 If these Terms and Conditions are not accepted in full, the use of this site must be terminated immediately.
